These Terms apply when you use our websites, deal pages, property alerts, and related services. By using the services, you agree to these Terms. The services are for people 18 and older.

Property information

Property information is believed to be reliable but is not guaranteed. Property details, photos, estimates, and condition notes may come from sellers, agents, contractors, public records, or other third parties. Off Market Daily does not independently verify all information.

As-is properties and buyer responsibility

All properties are offered as-is. Buyers are responsible for their own inspections, due diligence, valuation, financing, title review, and professional advice before entering a transaction. You should verify every fact that matters to your decision.

No brokerage or agency relationship

Off Market Daily is not a licensed real estate broker and does not act as an agent for any party. Using the services, receiving an alert, or communicating about a property does not create a brokerage, advisory, fiduciary, or agency relationship.

Communications

If you choose to receive property alerts, you may receive messages through a text-messaging platform or an email service. Reply STOP to opt out of SMS messages. Use the unsubscribe link to opt out of marketing emails. Message and data rates may apply.

Acceptable use

Do not misuse the services, attempt unauthorized access, interfere with operation, submit false information, copy content for unlawful purposes, or use the services in a way that violates another person's rights or applicable law.

Content changes

We may correct, modify, suspend, or remove property listings, website content, or features at any time. A property may become unavailable without notice.

Third-party services and links

The services may rely on or link to third-party websites and technology. Off Market Daily does not control third-party services and is not responsible for their availability, security, or content.

Limitation of liability

To the fullest extent permitted by law, Off Market Daily is not liable for indirect, incidental, special, consequential, or punitive damages, lost profits, lost opportunities, or investment losses arising from use of the services or reliance on property information. Off Market Daily's total liability for a claim related to the services will not exceed the amount you paid Off Market Daily to use the services during the 12 months before the claim. If you paid nothing, the total liability will not exceed $100.

Some jurisdictions do not allow certain liability limits, so those limits apply only to the extent permitted by law.

Governing law and venue

Arizona law governs these Terms, without regard to conflict-of-law rules. Any dispute must be brought in the state or federal courts located in Maricopa County, Arizona. These Terms do not require arbitration.

Changes to these Terms

We may update these Terms as our services change. The Last updated date shows when the latest version took effect. Continued use after an update means you accept the revised Terms.
